Samsung Wins Legal Battle With Apple, As Galaxy Tab 10.1 Ban on Shipments is Lifted

Score one for Samsung here, as the Asian giant managed to have its ban on the Galaxy Tab 10.1 slate lifted. Previously, a German court decided to forbid the company to sell its new tablet throughout Europe, with the exception of Holland. Now, they’ve backed out of this decision.

What Apple received in the first place was a preliminary injunction and the Netherlands market will be addressed in a further suit in mid-September. There will also be a hearing in a German court on August 25th and over the past week, we’ve found something pretty nasty on Apple’s side: tampered evidence. It appears they’ve used, either by mistake or voluntarily some edited pictures that made the Samsung Galaxy Tab 10.1 seem more similar to the iPad.

It seemed strange in the first place a court in Germany can rule out a product for the entire Europe. Who are they to decided for other territories? Samsung caught wind of that and only admitted the authority of the German court in Germany, not the entire Europe. The German branch of Samsung remains under ban, at least for now, but in the following weeks that will be solved as well. With HTC also attacking Apple now that the Motorola patents are in Google’s possession, the fruit should be worried right about now…

Final Round of Legal Kickboxing for Apple and Samsung on August 25

You must be aware that Apple got the first results of its legal campaign against Samsung, having a German court decide to ban the Galaxy Tab 10.1 from sales in Europe, aside from Holland. Well, Samsung isn’t going to tolerate that without a fight, so the final round in this legal battle will take place on August 25, according to Reuters.

The South Korean company intends to get a ban lifting for its new tablet in the European Union and maybe it will get the same thing for the Aussie market. In case you’re wondering why Apple attacked Samsung in court, the reason is the usual one: copied products and the Galaxy Tab 10.1 supposedly copying the iPad 2.

Samsung has lawsuits with Apple in the US, Australia and basically all over the world for the same reason: infringement of intellectual property and patents. While August 25 will be the hearing date, weeks will pass till a decision is made and meanwhile Samsung is hurt, since its new tablet can’t be sold. The case’s judge, Edger Brinkman informed the court that a decision will be reached by September 15 and that a possible injunction could come into effect around mid October.
